                      The following order was made in
the above titled cause by Judge Baker at the last
term of this Court
                 Let the case be placed upon the
absentee docket and the bond cancelled

It appearing to the Court that the above order was
granted by Judge Baker at the last Term of the
Court, it is ordered that it be Entered up at this Term
of the Court Nunc protunc

                       The plaintiffs Counsel will take notice that
we will move the Court on arrest of Judgement in said
Case when judgement is Entered nunc protunc on the ground that
the judgement is illegal for that the Jury who tried the case
was not summoned or impannelled according to law

Take further notice that we will move the Court to Strike from
the Minutes of the full Term 1861 so as to annull the Judgement
Entered in Said case, it having been entered up by the Clerk in
