  Tuesday Oct 13th 1863

                 And now on this day came the parties by their
respective attornies and whereupon came a Jury to wit
1  J.K. Stephens               5  T.E. Haile              9   J.M. Richardson
2  J.J. Mickle                 6  Elias Earl              10  D. Blake
3  J.H. Malphurs               7  F.A. Shannon            11  J.A. Goff
4  W.A. Turner                 8  H.L. Meeks              12  C.L. Dinkins
who being duly Sworn well and truly to try the issue Joined between
the parties after hearing the testimony of Witness the argument of
council, and the charge of the Court, returned to consider of
their verdict and thereafter on the same day returned onto
court and rendered the following verdict to wit We the Jury find
for the defendant and assess the damages at Thirteen hundred &
One 61/100 Dollars, Whereupon it is ordered Considered & adjudged by the
Court that the plaintiff do have and recover of and from the defendant
the said Sum of Thirteen hundred & One 61/100 Dollars for his damages
together with his Cost in this behalf expended taxed at
                     Dollars &                Cents and the
defendant in mercy

       vs          }       asst
Wm Hark }  And now on this day came the parties
by their respective attornies and the defendant Saying nothing 
in bar or preclusion of the plaintiffs right to recover On motion
of plaintiffs attorney, It is ordered that the Plaintiff do have his 
Judgment against the defendant by default and that the Clerk 
do assess the damages Whereupon the Clerk having assessed the 
damages at   Six hundred & twenty four
       Dollars & Seventy ------------------  Cents, it is ordered 
Considered and adjudged by the Court that the Plaintiff do 
have and recover off and from the defendant the said sum of 
   Six hundred & twenty four     dollars & Seventy ------
  cents for his damages together with his Costs in this behalf expended
taxed at             dollars & 
   cents and the     defendant in Mercy &c

           Adjourned untill tomorrow 10 OClock
