In the Matter of the application of John J. Tyner for
discharge under writ of Habeas Corpus
After hearing the return made by Capt S.D. McConnell
Captain of Company "G" of 7th Fla. Regmt who holds
the applicant under arrest and the proofs made in the
case The Court is of the opinion that John J. Tyner was
never regularly & legally mustered into Company "G" of 7
Regt Fla. Vols and according to the proofs before the Court
no acts upon his part were performed sufficient to
constitute him a Member of Co. "G" of said Regt
It is therefore ordered adjudged & decreed that the
said John J. Tyner be discharged from the arrest made
by S.D. McConnell Captain of Co. "G" of the 7th Regt. Vols. Fla.
