prosecuting the pleas of the State in this behalf as well the
prisoners James M. Hawthorne Anderson Philpot &
Samuel Swindle who having pleaded not guilty
to the Charge in said indictment Contained &
therefore Came a jury to wit

2 F.T. Baker 8 Asa Clark Junr
3 Henry Fewell 9 James M. Sparkman
4 John Little 10 T.B. Holder
5 John T. Prevatt 11 Mitchel Kirkland
6 Samuel J. Kennard 12 Louis Shearhouse
who having duly elected tried & sworn well & truly
to enquire of the charge having had the evidence
& argument of Counsel & Charge of the Court retired to
Consider of their verdict and having Considerd
thereof they returned into Court with the following
verdict, we the jury find the prisoners Samuel Swindle
& Anderson Philpot guilty and assess their fine at
One hundred dollars each & find James M. hawthorn
not guilty. It is therefore ordered by the Court that the Defendants
Samuel Swindle & Anderson Philpot stand committed until the fine and
costs are paid and that James M. Hawthorn be discharged
