And now on this day came the parties by their
respective attornies, and the defendant Saying nothing in bar
or preclusion of the plaintiffs right to recover on motion of
plaintiffs attorney it is ordered that the plaintiff do have his
Judgement against the defendant by default & that the Clerk
do assess the damages Whereupon the Clerk having assessed
the damages at Two Thousand one hundred & fifty Eight dollars It is ordered
Considered and adjudged by the Court that the plaintiff do
have and recover off and from the defendant the said sum of
Two thousand one hundred & fifty eight dollars & ten cents for his damages together
with his Cost in this behalf expended taxed at
Eight dollars & Twenty Nine Cents and the defendant in
Mercy &c

William F. Jones Admr &c} Means & McDonell
And now on this day came the parties by their respective
attornies and the death of the defendant James G. Jones being
Suggested at the last term of the Court to wit the Fall Term 1866
& William F. Jones having been made a party to the above Cause
& the defendant Saying nothing in bar or preclusion of the plaintiffs
right to recover on motion of the plaintiffs attorney it is ordered that
the plaintiff do have his Judgement against the defendant by
default to be recovered out of the goods & chattels, right &
credits which were of William C. Cunningham deceased and
that the Clerk do assess the damages Whereupon the Clerk
having assessed the damages at Thirty Eight hundred & fifty
nine dollars & Eighty Eight Cents it is ordered Considered and
adjudged by the Court that the plaintiff do have and
recover off and from the defendant the said Sum of Thirty
Eight hundred & fifty nine dollars & Eighty Eight Cents for his damages
together with his Cost in this behalf expended taxed at
dollars & Cents & the
defendant in Mercy &c
