And now on this day came the parties by their respective attor
=nies and the death of the defendant James G. Jones being Sugges
=ted at the last term of the Court, to wit the Fall Term 1866 &
William F. Jones having been made a party to the above cause
& the defendant Saying nothing in bar or preclusion of the plain
=tiff right to recover on motion of plaintiffs attorney it is ordered
that the plaintiff do have his judgement against the defend
ant by default to be recovered out of the goods & chattels rights & credit of W.C. Cunningham deceased &
that the Clerk do assess the damages Where
upon the Clerk having assessed the damages at Four thous
=and Seven hundred & Sixty one dollars & Forty two Cents, It is
ordered Considered & adjudged by the Court that the
plaintiff do have and recover off and from the defendant the
Said Sum of Four thousand Seven hundred & Sixty one Dollars &
Forty two Cents for his damages together with his Cost in this behalf
expended taxed at dollars

credits which were of William C. Cunningham deceased, and
that the Clerk do assess the damages Whereupon the Clerk having
assessed the damages at One hundred & thirty nine dollars & Seventy three
Cents it is ordered Considered & adjudged by the Court that the plaintiff
do have and recover off and from the defendant the Sum of One hundred
& thirty nine dollars & Seventy Three cents for his damages together with his Cost in
this behalf expended taxed at dollars &
