And now on this day this cause coming on to be heard
the same was submitted to a Jury duly impannelled and sworn and
after having the case submitted to them retired to their room and
after deliberation returned the following verdict - "We the Jury find for
the defendant 17" Nov A.D. 1868 - signed Walter S. Land - Foreman
And it was thereupon ordered and adjudged by the Court that the
same be recorded and it is further ordered and adjudged by the
Court that the defendant do have and recover of and from the Plaintiff his
cost in this behalf expended Whereupon the Clerk assessed the Costs at
the sum Dollars & cts
and the Plaintiff be in mercy &c

And now on this day came the parties by their
respective Attorneys and the defendant saying nothing in bar or pre-
clusion of the Plaintiff's right to recover, on motion of Plaintiff's attorney
It is ordered that the plaintiff do have his Judgement against the defen
dant and that the Clerk do assess the damages. Whereupon the Clerk
there having assessed the damages at One hundred and Sixty two
Dollars and ---------- cents It is ordered, considered and ad-
judged by the Court, that the Plaintiff do have and recover of and from the
defendant the said sum of One hundred & Sixty two Dollars and
cents for his damages together with his costs taxed at Six
Dollars twenty cents and the defendant in mercy
&c
