And now this day came the parties by their
respective Attorneys and the defendant saying nothing in bar
or preclusion of the Plaintiff right to recover On motion of the
Plaintiffs atorney it is ordered that the Plaintiff do have his
Judgement against the defendant and that the Clerk do
assess the damages Whereupon it is ordered, considered and ad-
judged that the Pl the Clerk having assessed the damages
at three thousand Dollars ---- cts
It is ordered, considered and adjudged that the Plaintiff do
have and recover of and from the defendant the said sum
of Three thousand Dollars ---
cents for his damages together with his costs taxed at
five Dollars thirty seven cents and that the
defendant be in mercy &c

Who being duly sworn and truly to try the issue joined
by the parties, after hearing the testimony of witness the
argument of Counsil, and the charge of the Court,
returned to consider of their verdict and thereupon on
the same day returned into Court and rendered the
following verdict We the jury find for the Defendant &
assess the damages at One hundred & thirty --- Dollars &
fifty six Cents whereupon it is ordered Considered
and adjudged by the Court that the Plaintiff do
have and recover off and from the defendant the said
Sum of 130 ------------- Dollars & 56 -------------
Cents for his damages together with his cost taxed at
Dollars & cents and the
defendant in mercy &c
