The Grand Jury came into Court and made the
following presentment State of Florida vs Cornelius
Rain, Senr Cornelius Rain Jnr, & Zack Haddock
Cause Riot and assault ----
In the fifth Judicial Dist. of
Florida Fall Term 1868
Alachua County: To Wit =
It appearing to the Court that Arch
=bald T. Banks Solicitor had been retained as
Counsel for Defendants at preliminary hearing of a
cause in which the State of Florida is Plaintiff
and Emmett Wright Hezekiah Fason and Dick Nelson
are defendants: It is therefore ordered that George J.
Arnow Esqr. be requested to act as Solicitor for the
State in the prosecution of Said Cause

And now this day came the
parties by their respective attornies and the defendant
Saying nothing in bar or preclusion of the Plaintiffs
right to recover on motion of Plaintiffs attorney it is
ordered that the Plaintiff do have his Judgement
against the defendant by default and that the
Clerk do assess the Damages Whereupon the
Clerk having assessed the damages at One hun
=dred & Seventy five dollars and One Cent, It is ordered
Considered and adjudged by the Court that the
Plaintiff do have and recover off and from the
defendant the said sum of One hundred & seventy
five dollars & one Cent for his damages together with
his costs taxed at Eight dollars & fifty cents and
the defendant in mercy &c
