And now on this day came
the parties by the Solicitor George J. Arnow appointed
by the Court to prosecute the above entitled cause
for the State in this behalf, as well as the prisoners
in person, to wit: Bill Morgan, Alfred McCall, and
Smart Walker, Hezikiah Fason, upon Motion of
Counsil for the State, a Severance was entered into
as to Emmit Wright, who was not arrested and a
nolle prosequi entered into as to Hezikiah Fason
the prisoners Bill Morgan, Alfred McCall and
Smart Walker were duly arraigned and pleaded
not guilty thereupon came a Jury to wit

3 James Ford 9 Andrew Mayo
4 George Frink 10 Robert Lord
5 W.D. Hamilton 11 Edward Burt
6 Henry Avera 12 Henry Osteen
who having been duly Sworn well and truly to try
and true deliverance make, between the State of Florida
and the prisoners at the Bar, after hearing the
Evidence of the State the Court took a recess untill
tomorrow 9 OClock, the Jury in charge of two Sworn
Bailiffs, under instructions of the Court,
Wednesday November 24th 1868 Court met pur
=suant to adjournment the Counsil for the prisoners
offering no testimony, After hearing the arguments
of Counsil both for the State and prisoners, & the charge
of the Court the Jury retired under charge of a
Bailiff to Consider of their Verdict, and afterwards
on the Same day returned into Court and rendered
the following verdict We the Jury find the prisoners
Bill Morgan, Smart Walker and Alfred McCall
Guilty Whereupon it is ordered Considered and
adjudged by the Court that the said Bill Morgan
Alfred McCall & Smart Walker
